1. Since Bolt provides services for the information society (being a means of communication between passengers and drivers), Bolt cannot guarantee the quality or absence of defects in the provision of transport services by drivers. Because the provision and availability of transportation services depends on drivers, Bolt does not guarantee the availability of drivers to provide transportation services.
2 The Bolt App does not offer or provide transportation services for passengers. In addition, Bolt is not a transportation agency for finding passengers for transportation companies. The Bolt application is used as a means of organizing the provision of transport services.
3 The consumer’s right to a refund does not apply to orders in the Bolt application. A request for reimbursement of the cost of the transport service does not remove you from the contract under which the provision of transport services was ordered.
4 The Bolt App is provided on an “as is” and “as available” basis. Bolt does not represent or warrant that access to the Bolt App will be uninterrupted or error-free. In the event of any errors in the software, we will endeavor to correct them as soon as possible, but please note that the functionality of the application may be limited by occasional technical errors and we cannot guarantee that the application will function at all times, for example an emergency situation may lead to service interruption.
5 Bolt, its representatives, directors and employees shall not be liable for any damage or loss that may arise from the use of or reliance on the Bolt App or a trip booked through the Bolt App, including but not limited to any direct or indirect material damages or monetary losses; loss of profit; loss of business, contracts, contacts, goodwill, reputation and any loss that may arise from business interruption, loss or inaccuracy of data and any other type of damage or loss.
6 The material liability of Bolt in connection with the breach of contract will be limited to 500 euros. You will only be entitled to claim damages if Bolt willfully breached the contract. Bolt is not responsible for the actions or omissions of the driver and is not responsible for any damages caused by the driver to passengers.
7 You agree to fully indemnify and hold Bolt, its affiliates, representatives, employees and directors harmless from any claims or damages (including liability for damages and expenses of any nature) that they may incur as a result of your use of the Bolt App (including rides you get by using the Bolt app).
8 Bolt may immediately terminate your use of the Bolt App if you breach these General Terms and Conditions or if we deem it necessary to protect the integrity of Bolt or the safety of drivers.
Good practices for using the Bolt application
1 As Bolt is not a provider or intermediary of carriage services, any matter relating to defects or quality of carriage services shall be resolved in accordance with the rules and regulations of the carriage service provider or the relevant supervisory authority body
2 We ask that you fill out the feedback form in the Bolt app. This allows us to provide drivers with suggestions for improving the quality of their service.
3 We expect users of the Bolt app to use the app in good faith and to respect the drivers who offer their services through Bolt. Bolt reserves the right to limit your access to the service if you have violated the conditions set forth in these General Terms and Conditions, or if your activity is harmful, for example, in the case of withholding payment for the provision of transportation services, fraud, contempt. In these cases, your Bolt account may be canceled without notice.
4 Bolt makes every effort to ensure that only reliable drivers who respect the profession and customers use the Bolt App. However, we cannot guarantee that every transportation service provider always meets the specified criteria. If you have experienced inappropriate transport services, please notify the company responsible for providing the service, the supervisory authority or our support team.
Changes to the General Terms and Conditions
1 If any material changes are made to the General Terms and Conditions, you will be notified by email or the Bolt app. Your continued use of the Bolt App will constitute your acceptance of the changes.
1 The General Terms and Conditions shall be governed by, construed and enforced in accordance with the laws of the Republic of Estonia. If a related dispute arising out of these General Terms and Conditions or the Agreement cannot be settled by negotiation, such dispute shall be finally settled in the Garyu County Court in Tallinn, Republic of Estonia. If any provision of the General Terms and Conditions is deemed invalid, the parties will replace the relevant provision with an enforceable one that approximates the intent and economic effect of the relevant provision.
